Why was the cheque given it to you ? was it given to discharge liabilty? Please clarify. If the cheque is given to discharge liabilty then you have two remedies ,one in civil to file a case u/o 37 cpc for recovery and criminal to file a complaint u/s 138 N.I.act to punish the defaulter.
