Question

My daughter who was married in April 2013 and residing in the ground floor of the in-law's house given by father in law, is being troubled by the boy's step mother to vacate the house. She is also giving her threats whenever the boy goes for night shifts. My daughter is also working for a bank in Bangalore. I understand that my daughter can file Domestic Violence against the step mother and also father in law since of late he is also supporting the step mother. The property is in the name of father-in-law singly but financial support was given by the grand parents of the boy and deceased mother of the boy who was doing tailoring and running tuitions and kidshome. Kindly also let me know what is this "Right of Residence for the Daughter-in-law in her In-laws' house. Any other support my daughter can get through any law kindly advise to get rid of the torture of this step mother in law.

Question

Devorice and Raffle

I am going though a devorce and my husband and I own a 1994 Jaguar that we have been trying to sell. Can we raffle it off?

Answer

Re: Devorice and Raffle

You can do anything with it that's legal and that you both agree to. If there's debt on the car you need to bring along the creditors.

Question

credit card fraud

In the near future I may have need for a criminal defense attorney. My ex-girl friend who lives in PA has contacted the Lansdowne police dept claiming that I used her credit card without her permission. I live in Hammonton, NJ and all credit card purchases happened in NJ about 500 dollars in total I have been contacted by the Lansdowne police dept and the Sgt I spoke with states that he will have to do further investigations. What can I expect and isn't this a case of he said she said?

Answer

Re: credit card fraud

I would call a NJ attorney. You could retain one for a very small retainer to deal with the police for you. Call me at 732/247/3340 to discuss.

Answer

Re: credit card fraud

Its not quite as simple as "he said/she said" because there are going to be actual receipts for actual credit charges. Proving whether various bills were authorized is going to be more difficult. There is also a question about whether the police in PA have jurisdiction over the case. The potential problems that you face from this are much greater than the relatively small amount of money involved in the credit card bills. You really ought to speak with an attorney.

Answer

Under Florida law, a call cannot be recorded without your knowledge. Of course, now you know you're being recorded, so it's not illegal. A Florida judge would also frown (at least) on the mother recording the calls and would almost certainly disallow it.

However, the kids are in New Jersey, so the applicable law is probably not Florida law but New Jersey law. If your visitation order is from Florida, you may want to consider a motion for contempt in Florida. If your visitation order is from someplace else, you should talk to a New Jersey lawyer or a lawyer from the state where your visitation order comes from.
